			<description><![CDATA[Answer: No.<br /><br />Businesses that are open to the public and have no appropriate alcohol license cannot sell or give away or provide tastings of alcohol, including beer, wine, or spirits, to the public. <br /><ol>
<li>An alcohol license is required to serve alcohol beverages.  Wis. Stat. s. 125.04(1) states that no person (person includes individuals, corporations, LLC’s, etc.) may sell or engage in any other activity for which this chapter provides a license without holding the appropriate license.  The City of Eau Claire forfeiture for violation of this statutory provision is $452.50.  The penalty under state law is a forfeiture of up to $10,000, nine months in jail, or both (Wis. Stat. s. 125.04 (13)).</li>
<li>If a business does not have an alcohol license, alcohol beverages cannot be sold or given away.  Wis. Stat. s. 125.09(1) prohibits “consumption” of alcohol in unlicensed public places.  For example, a business at an unlicensed premise cannot have an open house, grand opening, or event that caters to the general public and serves alcohol. </li>
<li>Any charge made directly or indirectly for the alcohol beverage requires the person in charge to hold the appropriate license.  The term “sale” is broadly defined.  “Sale” is a transfer with consideration or transfer without consideration, if made to evade law, or any shift, device, scheme, or transaction for obtaining an alcoholic beverage (Wis. Stat. s. 125.02(20)).</li>
</ol>Examples of indirect charges include, but are not limited to, a ticket price including an alcohol beverage, cost of a meal including an alcohol beverage, a purchase of a service with a “free” alcohol beverage, or a donation required in order to consume an alcohol beverage.<br /><br />Wis. Stat. s. 125.315 prohibits the “giving” of fermented malt beverages to evade law (i.e., businesses such as credit unions, barbershops, salons, etc., giving away beer to customers without a fermented malt beverage license).  Wine and spirits also cannot be given away in the same manner under Wis. Stat. s. 125.67.  Again, the penalty under state law is a forfeiture of up to $10,000, 9 months in jail, or both (Wis. Council President Kincaid called the meeting to order.  The following members were present:  Council Members David Duax, Kerry Kincaid, David Klinkhammer, Jackie Pavelski, Bob Von Haden, Thomas Vue, Dana Wachs and Andrew Werthmann.  Absent:  Council Members Larry Balow, Thomas Kemp and Berlye Middleton.  <br /><br />

<br />The Council considered a resolution adopting the Consent Agenda for selected items of routine business on Tuesday, February 23, 2010.  Thereupon a motion was offered by Council Member Klinkhammer and seconded by Council Member Wachs “to adopt the consent resolution”.  Said motion passed by unanimous vote.  <br /><br />

<br />The City Council considered a resolution granting a Class B Fermented Malt Beverage license and Class A Cabaret license to Eau Claire Children’s Theatre, Inc., d/b/a Eau Claire Children’s Theatre, 1814 Oxford Ave., Wayne Marek, agent.  Thereupon a motion was offered by Council Member Pavelski and seconded by Council Member Von Haden “to adopt said resolution”.  Said motion passed by the following vote:  Aye:  Council Members Kincaid, Klinkhammer, Pavelski, Von Haden, Vue, and Wachs.  Nay:  Council Members Duax and Werthmann.  <br /><br />
<div style="text-align: center;"><strong>GRANTS</strong><br /></div>
<br />The Council considered a resolution authorizing the Fire Department to accept and appropriate a Department of Homeland Security grant in the amount of $27,184 to purchase mobile and portable radios.  Thereupon a motion was offered by Council Member Vue and seconded by Council Member Duax “to adopt said resolution”.  Said motion passed by unanimous vote.<br /><br />The Council considered a resolution approving participation in and a pledge of support for the Broadband Technology Opportunities Program (BTOP) grant application.  Thereupon a motion was offered by Council Member Werthmann and seconded by Council Member Klinkhammer “to adopt said resolution”.  Said motion passed by unanimous vote.<br /><br />
<div style="text-align: center;"><strong>EASEMENT</strong><br /></div>
<br />The City Council considered a resolution accepting a permanent easement and a temporary construction easement from Thomas Johnston for construction of a relief storm sewer to serve the Stein Boulevard and West MacArthur area.   Thereupon a motion was offered by Council Member Wachs and seconded by Council Member Pavelski “to adopt said resolution”.  Said motion passed by unanimous vote.<br /><br /><br />The Council considered a resolution releasing the utility easement crossing 3913 Scotch Pine Court.  Thereupon a motion was offered by Council Member Von Haden and seconded by Council Member Vue “to adopt said resolution”.  Said motion passed by unanimous vote.<br /><br />
<div style="text-align: center;"><strong>DEVELOPMENT BONDS – FTL SYSTEMS INCORPORATED</strong><br /></div>
<br />The City Council considered a resolution relating to industrial development revenue bond financing on behalf of FTL Systems Incorporated.  Thereupon a motion was offered by Council Member Duax and seconded by Council Member Werthmann “to adopt said resolution”.  Said motion passed by unanimous vote.<br /><br />Council Member Werthmann left the Council Chamber.<br /><br />The Council considered a resolution authorizing a waiver of Section 66.1103(11)(b)1, Wisconsin Statutes, relating to competitive bid requirements, in connection with an industrial development revenue bond financing on behalf of FTL Systems Incorporated.  Thereupon a motion was offered by Council Member Klinkhammer and seconded by Council Member Wachs “to adopt said resolution”.  Said motion passed by unanimous vote.<br /><br />Council Member Werthmann returned to the Council Chamber.<br /><br />
<div style="text-align: center;"><strong>CLAIREMONT AVENUE MEDICAL / EDUCATIONAL DISTRICT</strong><br /></div>
<br />The City Council considered a resolution approving the Clairemont Avenue Medical and Educational District Plan.  Thereupon a motion was offered by Council Member Klinkhammer and seconded by Council Member Duax “to adopt said resolution”.  Thereupon a motion was offered by Council Duax “to amend said resolution as follows:  <br />1.  In the 4th Whereas paragraph, delete the phrase ‘and east of Stein Boulevard’, and <br /> add ‘, and’ at the end of the paragraph; <br />2. Add a new 5th Whereas paragraph to read:<br /> ‘WHEREAS, all maps of areas south of West Clairemont Avenue in the report are <br /> for information only and do not constitute part of the planning recommendations <br /> for action’."<br />Said motion to amend was accepted by the mover as a friendly amendment.  The Council then voted on the resolution as amended.  Said motion passed by unanimous vote.<br /><br />

			<description><![CDATA[<img style="margin: 2px; float: right;" alt="mrc-logo" src="/images/stories/health/images/mrc/mrc-logo.gif" width="173" height="113" />The MRC program was created after President Bush's 2002 State of the Union Address, in which he asked all Americans to volunteer in support of their country. The MRC is comprised of organized medical, non-medical, and public health professionals who serve as volunteers to respond to natural disasters and emergencies. These volunteers assist communities nationwide during emergencies and for ongoing efforts in public health.
<p>The need for trained supplemental medical, non-medical, and public health personnel to assist with emergency operations was highlighted after the terrorist attacks of September 11, 2001. Many medical and public health professionals sought to support emergency relief efforts, but there was no organized approach to channel their efforts. The MRC program provides the structure necessary to deploy medical, non-medical and public health personnel in response to an emergency, as it identifies specific, trained, credentialed personnel available and ready to respond to emergencies.</p>

<p>In March 2009, the Eau Claire City-County Health Department invited community partners and members of the Eau Claire City-County Public Health Emergency Preparedness Committee to an information gathering session and discussion about forming a Medical Reserve unit to serve Eau Claire County.   Further discussion and review of after action reports from tabletop and functional exercises and hazard vulnerability analyses in Public Health Emergency Preparedness Committee meetings validated the need for a unit.</p>
A lot of groundwork has been done. The Eau Claire County MRC is federally approved and supported and listed on the national website (www.medicalreservecorps.com). The Eau Claire City- County Health Department sponsors the Medical Reserve Corps, is supported by the City-County Public Health Emergency Preparedness Committee, MRC Unit Advisory Committee, and County Emergency Management.]]></description>
